Your Personal Injury Settlement: What Does the Claim Cover?

If you are trying to value your potential personal injury claim, contact us today. Claims are not as simple as just calculating medical expenses and cutting a check. That's because the injuries and damages you incur are greater than just the cost of your past medical bills. You have been injured, you have suffered pain and suffering, you may have experienced a property loss, you may have lost pay due to time off work, or you may have even lost a family member or loved one. Obviously you should receive compensation that, as fully as possible, makes you whole once more.

Potential claims can be broken down into several different areas. Here are a few of the most common personal injury claims.

Medical Care

This includes not just the medical care you have received as a result of your injuries, but also medical care that you may require in the future. Medical care includes physician bills, costs of medical tests such as x-rays, CT scans, and MRIs, physical therapy, crutches or a wheelchair, hospital bills, and more. Before determining the amount of your medical claim, we aim to reach a point we refer to as Maximum Medical Improvement (MMI). This means that, based on your doctor's professional opinion, your injuries have healed as much as they will. You may still require ongoing treatment and therapy, however it is safe to assume that you will not improve much from this point. Determining the value of your medical care claim is usually fairly straightforward. Add up the cost of all your medical bills and estimate the cost of any future care you may require.

Lost Wages

You may have had to take time off work as a result of your injuries, or perhaps you had to transition to work in a different area and taken a loss of pay as a result. You have a right to receive compensation for these losses. If you worked construction but had to work an office job for a few months as a result of a broken leg, you may be entitled to receive compensation for the amount of income you lost from your injuries and the loss of your ability to earn money in the future.

Pain and Suffering

It is difficult to attach a monetary figure to pain and suffering. One of the most common ways to determine pain and suffering is the multiplier method. The multiplier takes the total sum of your medical expenses and multiplies that figure by somewhere between 1.5 and 4. Minor injuries are often on the lower end of that range, while major life-changing injuries may be on the higher end. Also, injuries that were incurred as a result of negligence or egregious behavior (as opposed to an accident) may also be at the higher end. This is a rough rule of thumb only! Each case is special and we evaluate the pain and suffering of each client individually.

Property Damage

Perhaps the easiest part of your claim to determine are your property damages. These damages include damages to your vehicle, clothing, or any personal items. You can also recover damages for loss of use, sales tax and tag fee if your car is totaled.

As you can tell, determining damages can be complicated. If you are unsure what damages you might receive as a result of your accident, contact us today!
